Elmwood, Nebraska Cemetery Association Fund

The purpose of the Fund is to encourage, solicit, receive, and use charitable contributions and the income derived therefrom (even to the point of exhaustion of principal) in support of the current and future needs of the Elmwood, Nebraska Cemetery Association.

The purpose of the Fund and the income derived therefrom (even to the point of exhaustion of principal) is for the perpetual care of the cemetery known as Elmwood Cemetery located on South 298th Street in Elmwood, Nebraska. The perpetual care shall be as directed by the Elmwood, Nebraska Cemetery Association in accordance with the provisions of Nebraska Revised Statutes Sections 12-510 and 12-511.  Such perpetual care may include the specific care of the lots, the maintenance, repair or replacement of fences, retaining walls, or other improvements surrounding Elmwood Cemetery, the roads within the cemetery, maintenance of grass, trees, internal fences or retaining walls, repair and replacement of headstones, purchasing additional land to expand the cemetery and any such other cemetery purposes as prescribed by the Elmwood, Nebraska Cemetery Association, as Trustee of the Fund in accordance with Nebraska Revised Statutes Sections 12‑510 and 12-511.

In accordance with Nebraska Revised Statutes Sections 12-510 and 12-511, the Fund is a provision for the discharge of a duty due from the persons contributing to the person or persons interred or to be interred in the Elmwood Cemetery, and likewise a provision for the benefit and protection of the public by aiding to preserve, beautify and keep cemeteries from becoming unkempt and places of reproach and desolation in the communities in which they are situated.
